Welcome to Trust Bloom ("TrustBloom," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (thetrustbloom.com), our automated Google review request, response, and reputation management platform, and any related services (collectively, the "Service"). By creating an account, subscribing to a plan, or otherwise using the Service, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
TrustBloom provides automated tools that help businesses collect, manage, and respond to online reviews, including but not limited to:
Automated review request messages sent via SMS and/or email to your customers
- AI-generated review responses
- Review routing (directing satisfied customers to public review platforms and routing negative feedback to private resolution)
- Integration with Google Business Profile and third-party CRM systems
- Reporting and analytics related to your review performance
2. Eligibility and Account Registration
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate, current, and complete information when creating an account and to keep this information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3. Subscription Plans, Billing, and Free Trial
3.1 Plans. The Service is offered on a subscription basis (e.g., Starter, Growth, Pro), with pricing and included usage limits (such as number of review requests per month) as described on our website at the time of purchase.
3.2 Free Trial. We may offer a free trial period (e.g., 7 days). Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
3.3 Billing. Subscriptions are billed on a recurring basis (monthly, unless otherwise stated) to the payment method on file. All fees are non-refundable except as required by law or expressly stated otherwise.
3.4 No Long-Term Contract. Plans are month-to-month. You may cancel at any time, effective at the end of your current billing cycle. Cancellation does not entitle you to a refund of the current billing period.
3.5 Price Changes. We may change our pricing with reasonable advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
3.6 Failed Payments. If a payment fails, we may suspend or terminate your access to the Service until payment is resolved.
4. Customer Data You Submit
To use the Service, you will provide contact information (such as names, phone numbers, and/or email addresses) for your own customers so that we can send automated review requests on your behalf. By submitting this information, you represent and warrant that:
- You have obtained all necessary consent from your customers to share their contact information with us and to have them contacted for review requests;
- Your collection and use of this data complies with applicable law, including consent and opt-out requirements for SMS and email communications (e.g., TCPA, CAN-SPAM, CASL, and similar laws in your jurisdiction);
- You will honor opt-out and unsubscribe requests promptly.
You are solely responsible for the lawfulness of the data you provide to us and for your own communications and marketing practices.
5. Acceptable Use
You agree not to use the Service to:
- Send unsolicited, misleading, or fraudulent review requests
- Solicit, incentivize, or fabricate fake or paid reviews in violation of Google's policies or applicable law
- Harass, defraud, or deceive any person
- Violate any applicable local, state, national, or international law
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service or related systems
We reserve the right to suspend or terminate accounts that violate this section.
6. Third-Party Platforms and Integrations
The Service integrates with third-party platforms, including but not limited to Google Business Profile, CRM systems, SMS/email delivery providers, and payment processors. Your use of those third-party platforms is subject to their own terms and policies, and we are not responsible for their acts, omissions, availability, or changes to their APIs or policies. Integration functionality may change or be discontinued if a third-party platform changes its terms or access.
7. Intellectual Property
All content, software, branding, and technology used to provide the Service are owned by TrustBloom or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your active subscription for your internal business purposes. You may not copy, resell, reverse-engineer, or create derivative works from the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC NUMBER OF REVIEWS, RATING IMPROVEMENTS, OR BUSINESS RESULTS. STATISTICS AND TESTIMONIALS ON OUR WEBSITE ARE ILLUSTRATIVE AND NOT A GUARANTEE OF YOUR RESULTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTBLOOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless TrustBloom, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party (including your customers).
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or misuse of the Service. You may cancel your subscription at any time through your account settings or by contacting us. Upon termination, your right to use the Service ends immediately; certain provisions of these Terms (including Sections 7–10) survive termination.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Delaware/USA, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts, and you consent to personal jurisdiction there.
